[Draft, to be reviewed by Mark or a legal professional before launch.]
This is a working draft prepared for Scratch ’n’ Match. It is general information only, not legal advice, and should be checked and tailored to the business before it goes live.
Scratch ’n’ Match (“we”, “us” or “our”) is a sole-operator, mobile car paintwork and scratch-repair business owned and run by Mark Wigoder. This policy explains what personal information we collect, why we collect it, and how we handle it in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
1. Who this policy applies to
This policy covers information we collect when you contact us for a quote or repair, send us photos of your vehicle, use our website, or otherwise deal with Scratch ’n’ Match. Because we are a mobile, service-area business, we do not operate a public shopfront or list a street address; we travel to you across Sydney’s North Shore, Northern Beaches and the Hills District.
2. The information we collect
We only collect the information we genuinely need to quote, schedule and carry out your repair. This may include:
- Your contact details, name, phone number, email address, and the suburb or postcode of the job so we can confirm you’re inside our service area.
- The job location, the address where the vehicle will be repaired. As a mobile service we use this only to attend the job; we don’t publish or share it.
- Vehicle details, make, model, colour and the condition of the paintwork or part to be repaired.
- Photos you send us, images of the damage that you provide so Mark can prepare a quote. These may incidentally show your number plate or surroundings; please don’t include anything you’d prefer us not to see.
- Website usage data, such as your IP address, device and browser type, and the pages you view, collected automatically through cookies and analytics (see section 7).
We do not collect sensitive information (such as health, financial or government-identifier details) and we ask that you don’t send it.
3. How we collect it
We collect most information directly from you, when you call or text, email us, or submit the photo-quote form on this website. Some website usage data is collected automatically by your browser and our analytics tools. If we ever collect information about you from someone else (for example, a family member arranging a repair on your behalf), we’ll handle it under this policy.
4. Why we collect and use it
We use your information to:
- prepare and discuss a no-obligation quote from your photos;
- confirm you’re within our service area and book a suitable time;
- carry out the repair and stand behind our workmanship warranty;
- contact you about your enquiry, booking, or completed job, by phone, SMS or email;
- respond to questions, feedback or warranty claims, and keep simple job records;
- maintain, secure and improve our website.
We will not use your information for unrelated purposes without your consent.
5. Contact and SMS consent
By giving us your phone number or submitting an enquiry, you consent to Mark contacting you about that enquiry by phone call, SMS/text message and email. We only message you about your quote, booking or repair, we don’t run automated marketing campaigns. You can ask us to stop contacting you at any time by replying to a message or calling 0412 555 687.
6. When we share information
Scratch ’n’ Match is run by one person, your details are not passed around a network of franchisees or operators. We do not sell, rent or trade your personal information. We may share limited information only where necessary with:
- Trusted service providers, for example our website host, form/email provider and analytics tools, who handle data on our behalf and are bound to keep it confidential;
- Authorities or advisers, where we’re required or authorised to do so by law, or to establish or defend a legal claim.
7. Cookies and analytics
Our website uses cookies and similar technologies to keep the site working, remember basic preferences and understand how visitors use our pages so we can improve them. You can block or delete cookies in your browser settings, though some parts of the site may not work as intended. Any analytics we use is to measure overall site performance, not to identify you personally.
8. Overseas disclosure
Some of our service providers (for example, website hosting or analytics) may store data on servers located outside Australia. Where that happens, we take reasonable steps to ensure your information is handled consistently with the Australian Privacy Principles.
9. Keeping your information secure
We take reasonable steps to protect your information from loss, misuse and unauthorised access, and to destroy or de-identify it when it’s no longer needed. No method of transmission or storage is completely secure, however, so we can’t guarantee absolute security of information sent to us over the internet.
10. How long we keep it
We keep job and contact records for as long as needed to provide the service, honour the warranty, and meet our legal and tax obligations. When information is no longer required, we take reasonable steps to delete or de-identify it. We may keep before/after photos as a record of the work; we only use them publicly with your consent (see section 11).
11. Use of repair photos
We may use “before and after” photos of completed repairs to show the quality of our work, for example on this website or social media - only with your consent. Where we do, we won’t identify you, and we’ll avoid showing identifying details such as your number plate. You can withdraw consent for future use at any time by contacting us.
12. Accessing and correcting your information
You can ask us what personal information we hold about you and request that we correct it if it’s inaccurate, out of date or incomplete. Just contact Mark using the details below. We’ll respond within a reasonable time and, in most cases, there’s no charge to access your information.
13. Children’s privacy
Our services are aimed at vehicle owners and other adults. We don’t knowingly collect personal information from children. If you believe a child has provided us with information, please contact us and we’ll delete it.
14. Complaints
If you’re concerned about how we’ve handled your personal information, please contact Mark first so we can try to put it right. If you’re not satisfied with our response, you can refer the matter to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
15. Changes to this policy
We may update this policy from time to time. The current version, with its “last updated” date, always appears on this page; please check back for any changes.
