Terms of Service

[Draft, to be reviewed by Mark or a legal professional before launch.]
This is a working draft prepared for Scratch ’n’ Match. It is general information only, not legal advice, and should be checked and tailored to the business before it goes live.
These terms apply when you request a quote, make a booking, or have a repair carried out by Scratch ’n’ Match, a mobile car paintwork and scratch-repair business owned and operated by Mark Wigoder. By contacting us for a quote or booking a repair, you agree to these terms.
1. About these terms
In these terms, “we”, “us” and “our” mean Scratch ’n’ Match, operated by Mark Wigoder; “you” means the person requesting a quote or repair. Please read them alongside our Privacy Policy. If you don’t agree with these terms, please don’t use our services or website.
2. Who we are
Scratch ’n’ Match is a sole-operator business, every quote and repair is handled personally by Mark, not by a franchise network or sub-contractors. We are a mobile, service-area business and do not operate a public shopfront. We travel to you across the Upper North Shore · Lower North Shore · Northern Beaches · The Hills District (and a short surrounding buffer). ABN 34 597 002 001.
3. Our services
We provide mobile car paintwork and small-to-medium paint and scratch repair services, carried out at your home or workplace. Our work covers:
- Bumper scuff repair
- Panel scratch & scuff repair
- Body kit repair
- Respraying
- Minor scratch & scuff repair
- Headlight restoration
We specialise in paintwork and surface repairs and match each repair to your manufacturer’s factory colour. We do not provide panel beating, structural or mechanical work. Availability depends on your location being within our service area and on Mark’s schedule.
4. Quotes
We provide no-obligation quotes, usually from the photos you send us. A photo quote is an estimate based on the information provided. The final scope is confirmed once Mark sees the vehicle in person, as the damage may differ from what a photo shows or reveal further work. If the scope changes, we’ll talk it through and agree the approach with you before starting. We don’t publish prices; any amount is confirmed directly with you before work begins.
5. Bookings, access and conditions
Scheduling
Bookings are subject to availability and confirmed in advance. We’ll agree a time and the job location with you.
Changes and cancellations
If you need to cancel or reschedule, please give us at least 24 hours’ notice where you can [draft, confirm notice period] so the time can be offered to another customer.
Safe access
As a mobile service, you agree to provide safe, legal and reasonable off-street access to the vehicle at the agreed time, for example a driveway, carport or similar space. Some paintwork also depends on suitable weather and surface temperature; if conditions aren’t safe for a quality finish, we may need to reschedule.
6. Payment
Unless we’ve agreed otherwise in writing, payment is due on completion of the work. We’ll let you know the accepted payment methods when we confirm your booking.
7. Workmanship warranty and colour match
We back our work with a 12-month workmanship warranty. Every repair is matched to your manufacturer’s factory colour and blended into the surrounding finish for a result that sits naturally with the rest of the panel.
The warranty does not cover:
- new damage from a collision, kerbing, stone chips or the like;
- misuse, neglect, abrasive washing, or failure to care for the finish reasonably;
- pre-existing or undisclosed damage, rust, or prior repairs by others;
- normal wear and tear, or work later altered by someone other than us.
If something isn’t right, contact Mark and we’ll arrange to inspect and put it right under the warranty.
8. Your responsibilities
To help us do a good job, you agree to:
- give accurate information about the vehicle and the damage, including any previous repairs;
- disclose any known issues that may affect the repair or finish;
- remove valuables and personal items from the work area before we arrive;
- be present, or authorise someone on your behalf, at the agreed time;
- ensure the vehicle is reasonably accessible and clean to work on.
9. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits or excludes those rights. To the extent the law allows, and where the failure isn’t a major one, our liability is limited to resupplying the relevant service or covering the cost of having it resupplied. We are not liable for damage arising from undisclosed pre-existing conditions, or for loss that we could not reasonably have foreseen.
10. Photos and marketing
With your consent, we may use “before and after” photos of your repair to show the quality of our work. We handle these in line with our Privacy Policy, and you can decline or withdraw consent at any time.
11. Website and intellectual property
The content of this website, including text, graphics, the Scratch ’n’ Match name and logo, and our repair photos, belongs to us or is used with permission, and is protected by copyright. You may view and share it for personal, non-commercial use, but please don’t copy, reproduce or use it commercially without our permission. You agree to use the website lawfully and not to interfere with its operation.
12. Changes to these terms
We may update these terms from time to time. The current version, with its “last updated” date, always appears on this page and applies from when it’s posted.
13. Governing law
These terms are governed by the laws of New South Wales and the Commonwealth of Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
